Karnataka HC: Courts in crimes against women should rather act like Lord Krishna and protect Dharma than be a mute spectator

The Karnataka High Court has observed that courts should act as Lord Krishna to protect Dharma in order to ensure the safety of women. Courts cannot act like a mute spectator to allow injustice being done to the women for generations to generations, a division bench of Justice B Veerappa and Justice E S Indiresh said while dismissing an appeal filed by a rape convict accused of raping a 69-year-old woman in 2013.

“Presently time warrants that the court should go about as watchmen and ensure Dharma to secure the wellbeing of ladies, as examined under Article 21 of the Constitution of India and manage the violators including attackers harshly and seriously with iron hands. Courts should go about as Lord Sri Krishna of Mahabharata to ensure Dharma,” the seat noted in its request on September 8, while alluding to two stanzas in the Bhagavad Gita.

The seat was hearing an allure by the convict testing the request passed by a locale court of Dakshina Kannada dated November 14, 2014. The solicitor, who was a 24-year-old worker at the hour of executing the offence, was seen as blameworthy of assaulting a 69-year-elderly person, whom he used to call ‘grandmother’, at blade point and looting money and assets over Rs 55,000.

Guidance for the convict had looked for putting aside the locale court request by fighting that the proof did not authenticate his inclusion in the wrongdoing. Notwithstanding, the division seat maintained the lower court request condemning him to seven years thorough detainment and excused the allure.

The seat noticed that even after the slip by of 74 years of autonomy, ladies actually are undependable in possession of the violators of the law.
